Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and CardXpertAI, LLC ("CardXpertAI," "we," "us," or "our") governing your use of the CardXpertAI mobile application and our websites at cardxpertai.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & accounts
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.
2. The Service
CardXpertAI helps you identify trading cards from images, organize your collection, and view pricing and market information drawn from actual card sales and our pricing algorithm. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
3. Card values & estimates — no financial advice
Card identifications, prices, valuations, grading estimates, and alerts provided by the Service are informational estimates only. They are not guarantees of value, authenticity, grade, or sale price, and they are not financial, investment, or appraisal advice.
Card markets are volatile and estimates can be wrong. You are solely responsible for your own buying, selling, grading, and collecting decisions. Always do your own research and, where appropriate, consult a qualified professional before making a transaction. We are not a party to, and are not responsible for, any transaction you enter into with a third party.
4. Subscriptions & billing
Parts of the Service are free; premium features are offered through a paid subscription ("CardXpertAI Pro"). Subscriptions are sold and billed through the Apple App Store or Google Play, and are subject to those stores' terms in addition to these Terms.
- Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Managing & cancelling. You manage and cancel your subscription in your Apple or Google account settings, not through CardXpertAI directly.
- Refunds. Refund requests are handled by Apple or Google under their policies. Except where required by law, payments are non-refundable.
- Price changes. We may change subscription prices; changes apply to future billing periods and we will give notice as required by the app stores or applicable law.
5. Your content
You retain ownership of the images, notes, and other content you submit to the Service ("Your Content"). You grant CardXpertAI a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content solely to operate, provide, secure, and improve the Service (for example, to identify a card from a photo you upload and to maintain your Vault). You represent that you have the rights necessary to submit Your Content and that it does not violate any law or third-party right.
6. Acceptable use
You agree not to:
- use the Service for any unlawful, infringing, or fraudulent purpose;
- reverse engineer, decompile, scrape, or attempt to extract our data, source code, or underlying models except as permitted by law;
- interfere with, overload, or disrupt the Service or its infrastructure, or bypass rate limits or security measures;
- resell, sublicense, or commercially exploit the Service or its data without our written permission;
- upload malware, or content that is illegal, infringing, or that you do not have the right to submit; or
- misrepresent your identity or impersonate any person or entity.
7. Intellectual property
The Service, including its software, design, text, graphics, logos, and the CardXpertAI name and marks, and all associated intellectual property rights, are owned by CardXpertAI or its licensors and are protected by law. Except for the limited license granted to you in these Terms, we reserve all rights. You may not use our name or logos without our prior written permission.
8. Third-party services
The Service integrates with or relies on third parties, including Google and Apple sign-in, the Apple App Store and Google Play, and cloud and marketplace data sources. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. References to marketplaces or sold prices are for informational purposes and do not imply any partnership or endorsement.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, the licenses granted to you end; Sections that by their nature should survive (including 3, 5, 7, and 10–13) will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CARD IDENTIFICATIONS, PRICES, OR ESTIMATES ARE ACCURATE OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDXPERTAI AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless CardXpertAI from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.
13. Governing law & disputes
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in the United States, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim in your local courts. Nothing in these Terms limits any rights you have under mandatory consumer-protection laws in your jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and provide notice through the app or by email. Your continued use of the Service after the changes take effect means you accept the revised Terms.
